Take Notice that the Council of the Corporation of the Town of East Gwillimbury passed By-law No. 2022-046 on May 17, 2022 under Section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended.

Take Notice the last date for filing a notice of appeal to the Ontario Land Tribunal in respect of the By-law is the 17th day of June 2022. A Notice of Appeal setting out the reasons for the appeal must be filed with the Development Services: Planning Branch of the Town of East Gwillimbury and accompanied by the appropriate fee, as required by the Ontario Land Tribunal.

The Notice of Appeal must:

  1. Be filed with the Development Services: Planning Branch of the Town of East Gwillimbury
  2. Set out the reasons for the appeal
  3. Be accompanied by the fee prescribed by the Tribunal

Only individuals, corporations and public bodies may appeal a by-law to the Ontario Land Tribunal (OLT). A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the OLT, there are reasonable grounds to add the person or public body as a party.

Purpose and Effect

The purpose and effect of By-law No. 2022-046 is to amend Comprehensive Zoning By-law 2018-043 to regulate the use of land as it relates to Cannabis Production Facilities throughout the Town of East Gwillimbury in accordance with Section 34 of the Planning Act. By-law No. 2022-046 applies generally to all land within the Town of East Gwillimbury; therefore, a keymap has not been provided.

Public consultation on the Zoning By-law Amendment for Cannabis Production Facilities was provided through a notice published in the newspaper on March 31, 2021, with a Public Meeting held on April 20, 2022.
And Take Notice the Council of the Corporation of the Town of East Gwillimbury considered all written and oral submissions received as part of the decision-making process as discussed in Reports #P-2022-10, #P-2022-15.
