Averton 19267 Centre Street Proposal

Memorandum from July 18, 2017 CWC Meeting

A memo was present to provide an overview of the Ontario Municipal Board Pre-hearing Conference that was held on June 27, 2017 regarding 19267 Centre Street in Mount Albert. The parties and participants to the appeal were determined and a five-day hearing has been scheduled for this appeal. The hearing will occur from January 15, 2018 to January 20, 2018, in the Holland Landing Room of the East Gwillimbury Civic Centre. For more details, click here.

Upcoming Ontario Municipal Board Pre-Hearing

The Ontario Municipal Board has scheduled a pre-hearing conference for Tuesday June 27, 2017 at 10:00 AM. The pre-hearing will be held at the Town of East Gwillimbury Municipal Building, Holland Landing Room, 19000 Leslie Street in Sharon, ON. The Board has set aside one day for this pre-hearing conference, and formal notice of the pre-hearing conference will be issued in accordance with the Board’s usual service of notice protocol and procedures. 

February 22 Public Meeting and follow-up

A non-statutory public meeting was held on February 22, 2017 at 7 p.m.in the Council Chambers of the East Gwillimbury Civic Centre.

Council heard deputations from residents regarding the proposed development. A follow up memo will be presented at the March 7 Committee of the Whole meeting to identify next steps.

February 7 Council Recommendations

  1. That staff request that when the Ontario Municipal Board (OMB) makes a decision regarding the current Official Plan and Zoning By-law appeals by Averton Homes, that the OMB withhold the final approval of the Zoning By-law until the associated Site Plan Application has been approved by Town Council.
  2. That staff provide information to any interested residents about the OMB process, including how they can participate
  3. That the Town provide its consent at the OMB for any resident that seeks participant or party status to participate in the Official Plan and Zoning By-law appeals by Averton Homes
  4. That Council request that the OMB adjourn its meeting scheduled for March 16th. Note: This request has been granted. 
  5. That documents relevant to the appeals, including in-camera reports, the traffic study, and natural heritage evaluation, be posted at www.eastgwillimbury.ca/projects for residents to review. (Note: The Town requires consent from Averton Homes to post the executed Minutes of Settlement)
  6. That the Town schedule a meeting in the evening of February 22, 2017.

Helpful Links to the Ontario Municipal Board

For reference, the Ontario Municipal Board (OMB) case file for the appeals filed against the Town of East Gwillimbury’s Official Plan (for lack of municipal decision on the June 2010 Official Plan) is PL110659. Averton Homes was one of these appellants, and as such this case file is used for the Official Plan appeal on 19267 Centre Street. The Zoning By-law Amendment appeal has been consolidated with the Official Plan appeal and also uses the same case number.
