Committee of Adjustment

The Committee of Adjustment considers applications for minor variances and consents on an as required basis.  The Committee is composed of five members who are appointed by the Council of the Town of East Gwillimbury.

Roles and Responsibilities

The Ontario Planning Act gives authority to committees of adjustment to make decisions pertaining to the following matters:

  • minor variances to provisions of the Town’s Zoning By-law
  • consent (meaning “approval”) to sever land (the creation of a new lot) 
  • consent to convey lands (a minor adjustment in lot boundaries)
  • consent for the enlargement, extension or alteration of legal non-conforming uses of land, buildings or structures
  • consent to register a mortgage over part of a property
  • consent to register a lease, an easement or a right-of-way over part of a property for more than 21 years
  • validation of land title when there has been an error in the description of land
  • consent for the sale of a parcel of land as a result of a foreclosure or exercise of a power of sale in a mortgage of charge

In the consideration of applications made to the Committee of Adjustment, the Committee ensures that the proposal or request meets the provisions of the Planning Act and the general purpose and intent of the Town’s Official Plan and Zoning By-law.
